Terms of Service

Please read these Terms of Service ("Terms") carefully before using the WellKept Pet application (the "App"), operated by Arc Digital LLC ("Arc Digital," "we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
The App is intended for users 13 and older. If you are under 18, use the App only with the involvement of a parent or guardian, who is responsible for any purchase. By making a purchase, you confirm you are old enough to form a binding agreement or have your guardian's permission, and that the purchase is made through your own Apple ID.
2. License
Arc Digital grants you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own personal, non-commercial pet care tracking. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.
3. One-time purchase and billing
WellKept Pet is free to use for one pet. A single one-time purchase unlocks unlimited pets and PDF history export. There is no subscription and no recurring charge.
The purchase is made through the Apple App Store and billed to your Apple ID. Arc Digital does not process payments directly. Pricing is shown in the App before purchase and may change over time. Purchases can be restored on your other devices using the same Apple ID through the "Restore Purchase" option in the App. All refund requests are handled by Apple under Apple's policies; Arc Digital cannot issue refunds for App Store purchases.
4. Acceptable use
You agree to use the App lawfully and not to: violate any applicable law; attempt to gain unauthorized access to the App or interfere with its operation; reverse-engineer or tamper with the App; or use automated means to extract data from the App. You are responsible for the data you enter and for maintaining your own device and iCloud security.
5. Not veterinary advice
WellKept Pet is an organizational tool for tracking pet care information and reminders. It does not provide veterinary, medical, or professional advice, and it is not a substitute for the judgment of a licensed veterinarian. Reminders, schedules, and any information shown are aids only and may be incomplete, delayed, or inaccurate. Always consult a qualified veterinarian for your pet's health, medication, vaccination, diet, and care decisions, and never rely on the App in an emergency. You are solely responsible for your pets' care.
6. Your data and privacy
Your use of the App is also governed by our Privacy Policy, incorporated here by reference. Your data is stored on your device and synced through your private iCloud; Arc Digital does not collect or have access to it. You retain full ownership of everything you enter, and you can delete it at any time within the App.
7. Intellectual property
The App and its original content, features, design, and functionality are and remain the property of Arc Digital LLC. "WellKept Pet," our logo, and related marks are trademarks of Arc Digital LLC and may not be used without our prior written consent. You retain ownership of the data you enter.
8. Third-party services
The App relies on Apple (iCloud sync and App Store purchase) and RevenueCat (purchase management). Your use of these is subject to their respective terms and privacy policies, and we are not responsible for their practices. Apple's terms are at apple.com/legal/internet-services/itunes.
9. Disclaimer of warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT REMINDERS WILL ALWAYS BE DELIVERED.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ARC DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY HARM TO A PET OR LOSS ARISING FROM RELIANCE ON THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $10 USD.
11. Indemnification
You agree to defend, indemnify, and hold harmless Arc Digital LLC and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the App or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Missouri, and you consent to personal jurisdiction there.
13. Changes to these Terms
We may modify these Terms from time to time. We will update the effective date and note material changes in the App. Continued use after a revision takes effect constitutes acceptance.
14. Termination
These Terms remain in effect while you use the App. You may stop using the App at any time. Sections 5, 7, 9, 10, 11, and 12 survive termination.
